Terms of Service

These terms are the agreement between you and Modefai (modefai.com). By creating an account or using the service you accept them, together with the rules and guide and the Privacy Policy. If you do not accept them, do not use the service.

Modefai makes pictures of you wearing clothing, hairstyles or footwear, from a photo you upload and a picture of the piece. The pictures are made by AI. Modefai does not sell clothing: pieces in the Shop belong to their designers, and any purchase of a real piece is between you and that seller.

• You must be 18 or older.
• Give a real email address and confirm it. Keep your password to yourself: you are responsible for what is done through your account.
• One person, one account. Accounts may not be sold or handed on.
• You can stop using the service at any time and ask us to delete your account.

• Upload only photos of yourself, or photos you have clear permission to use, and only clothing pictures you own or may use.
• Not accepted: photos of anyone under 18, photos of someone else without their permission, nudity, photos taken without the person knowing, and pictures of lingerie, underwear, swimwear or other very revealing outfits.
• Do not use the service to make pictures that are sexual, that harass or deceive, that pass someone off as another person, or that break the law.
• Do not try to get around the checks, the limits or the payment system, copy the service by automated means, or disturb it for others.

Your photos stay yours. You give Modefai permission to store and process them only as far as needed to make, check, show and keep your looks. Every upload is checked automatically, and one that breaks these rules is refused.

Looks are made by AI and are an illustration, not a promise. The fit, colour, fabric and details of the real piece can differ from the picture.

• A look is an illustration of how a piece could look on you. It is not a photograph, a fitting, or advice about size.
• AI makes mistakes, and the same choices can give a different picture each time.
• Before buying a real piece, rely on the seller's own description, size guide and return policy, not on a look.
• Modefai and the designers in the Shop do not promise that a real piece will look or fit as it does in a picture, and are not responsible for a purchase made because of one.

You may use the looks made for you for your own personal purposes, including sharing them. You may not present them as real photographs in order to mislead, or use them to sell anything that is not yours to sell.

• Shop pictures belong to their designers. They are for trying on only: you may not download, copy or repost them.
• Links to where a piece is sold lead to sites we do not run and are not responsible for.
• Designers who list pieces confirm that they hold the rights to each picture, and accept that every piece is reviewed and can be removed.

• Looks are paid for with credits, bought in packs. There is no subscription. Prices are shown before you pay, and what a look costs is shown before you confirm it.
• Credits are spent when a look is started. They are returned automatically only when no picture could be made.
• A picture you do not like is not refunded, because the cost of making it has been incurred. Check your photo and your choices first.
• Credits have no cash value, cannot be transferred, and are not refunded once bought, except where the law gives you that right.
• Payments are taken by a payment company in the currency it shows you, which can differ from the listed price.
• Finished looks are kept for a limited time, set out in the rules and guide. Download the ones you want to keep.

If you were charged and received no credits, or were charged twice, write to support@modefai.com and we will put it right.

We may suspend or close an account that breaks these terms or the rules, that is used for fraud, or that puts others at risk. An account closed for breaking the rules is not refunded. We may also change or stop parts of the service. If we close the service altogether, we will give reasonable notice so that you can use your credits and download your looks.

• The service is provided as it is. We do not promise that it will always be available, free of errors, or that a look will meet your expectations.
• As far as the law allows, we are not responsible for indirect losses, or for losses from relying on a look, from a purchase made from a third party, or from events outside our control.
• As far as the law allows, our total responsibility to you is limited to what you paid us in the 12 months before the claim.

Nothing in these terms takes away rights that the law gives you as a consumer and that cannot be waived.

When these terms change, the date at the top changes with them. For a change that matters, we tell you in the app or by email before it takes effect. Continuing to use the service after that means you accept the new terms.
